1. About these terms

These terms apply when you use brandforgemarketing.co.za (the “Site”), run by Cianan Donald trading as BrandForge Marketing (“we”, “us”). By using the Site you agree to them. If you don't agree, please don't use the Site.

Sections 6 and 7 limit our responsibility. We've written them in plain language so you can see them clearly.

2. Who we are

The details below are given under section 43 of the Electronic Communications and Transactions Act.

3. Using the Site

You may use the Site for your own information and to contact us. Please don't copy or republish our content, designs or code without permission; try to break, overload or gain unauthorised access to the Site or our systems; send spam, malware or false information through our forms; or use automated tools to scrape the Site.

We may change, pause or remove the Site or any part of it at any time.

4. Prices and offers

Prices on the Site are in South African Rand and include all charges (we are not registered for VAT, so no VAT is added). We work hard to keep them accurate, but a price or description on the Site is an invitation to do business, not a binding offer. The price that applies is the one in your signed Order Form or written quote.

Any special offer shows its conditions and end date (or a limited number, such as “first 10 clients”) on the Site or in the quote.

Sending a form does not create a contract. A contract only exists once we both sign an agreement or you accept a written quote.

5. Your privacy

Our privacy notice explains what personal information we collect through the Site, why, who we share it with and your rights under POPIA.

6. Our content and other websites

We own the content, designs and code on the Site, or use them under licence. Sample websites shown on the Site are examples made for fictional or sample businesses unless we say otherwise.

The Site may link to other websites. We don't control them and aren't responsible for their content or privacy practices.

Information on the Site is general and may not suit your situation. It is not legal, financial or tax advice.

7. Limits on our responsibility

We provide the Site with reasonable care, but we can't promise it will always be available, error-free or free of viruses. Please use up-to-date security software.

As far as the law allows, we are not responsible for loss caused by using, or being unable to use, the Site, or by relying on general information on it. This doesn't apply to loss caused by our gross negligence or intentional wrongdoing, or to rights you have under the Consumer Protection Act that can't be excluded.

These terms only cover use of the Site. If you become a client, your signed agreement governs the services.

8. Changes and general

We may update these terms by posting a new version on the Site with a new date. The version on the Site when you use it applies.

South African law applies. If any clause is invalid, the rest stays in force.

Cookie notice

Cookies are small files a website stores on your device so it can remember things about your visit. Similar tools, such as pixels and local storage, work in a similar way.

  • Essential (used): makes the Site and its forms work and protects them from spam, for example Netlify's form handling.
  • Analytics (not used): would count visits and show which pages are used, for example Google Analytics.
  • Advertising (not used): would measure whether our ads lead to enquiries, for example the Meta Pixel or Google Ads tag.
  • Embedded content (none at present): maps, videos or booking widgets from other services may set their own cookies when you use them.

You can block or delete cookies in your browser settings; essential features may stop working if you do. If we add analytics or advertising cookies in future, we will only set them after you agree, and we will update this notice first.
